Terms and Conditions
Article 1 – Definitions
Organizer: Go2Piemonte BV registered under Chamber of Commerce number 76072274
Traveler: any person who wishes to enter into an agreement with Go2Piemonte BV regarding a Trip, and any person who, based on that agreement, has the right to travel;
Travel Service: the services that are part of the trip, such as passenger transport, car rental, accommodation, and excursions.
Travel Service Provider: the provider that performs part of the Trip, such as accommodation suppliers, carriers, external guides, etc.
Agreement: the agreement relating to the booked Trip, including these Terms and Conditions.
Written: in writing or by electronic means, including e-mail.
Terms and Conditions: these general terms and conditions.
Package Travel: a package trip within the meaning of the law.
Trip: a Package Travel or, if these Terms and Conditions are declared applicable, a single Travel Service.
Organizer: Go2Piemonte BV registered under Chamber of Commerce number 76072274
Traveler: any person who wishes to enter into an agreement with Go2Piemonte BV regarding a Trip, and any person who, based on that agreement, has the right to travel;
Travel Service: the services that are part of the trip, such as passenger transport, car rental, accommodation, and excursions.
Travel Service Provider: the provider that performs part of the Trip, such as accommodation suppliers, carriers, external guides, etc.
Agreement: the agreement relating to the booked Trip, including these Terms and Conditions.
Written: in writing or by electronic means, including e-mail.
Terms and Conditions: these general terms and conditions.
Package Travel: a package trip within the meaning of the law.
Trip: a Package Travel or, if these Terms and Conditions are declared applicable, a single Travel Service.
Article 2 – Applicability of the Terms and Conditions
2.1 Package Travel These Terms and Conditions apply to all Package Travel arrangements offered or agreed upon with the Organizer.
2.2 Travel Services These Terms and Conditions may also be declared applicable to Travel Services that do not constitute a package trip. Title 7a of Book 7 of the Dutch Civil Code, which contains rules on package travel agreements, will in that case not apply. For these Travel Services, no insolvency protection of the Organizer applies, unless expressly stated in the offer which party provides coverage and this follows from the guarantee or insurance conditions.
2.3 Deviating and additional conditions Deviating and additional conditions must be agreed upon in Writing and take precedence over these Terms and Conditions.
2.1 Package Travel These Terms and Conditions apply to all Package Travel arrangements offered or agreed upon with the Organizer.
2.2 Travel Services These Terms and Conditions may also be declared applicable to Travel Services that do not constitute a package trip. Title 7a of Book 7 of the Dutch Civil Code, which contains rules on package travel agreements, will in that case not apply. For these Travel Services, no insolvency protection of the Organizer applies, unless expressly stated in the offer which party provides coverage and this follows from the guarantee or insurance conditions.
2.3 Deviating and additional conditions Deviating and additional conditions must be agreed upon in Writing and take precedence over these Terms and Conditions.
Article 3 – Formation of the Agreement
3.1 Content of the offer The offered Trip includes only the services and facilities expressly described in the Organizer’s quotation and publications. Information in publications of Travel Service Providers is not part of the offer, regardless of whether a link is included in the Organizer’s offer. The stated travel duration is given in full days, with both the departure and return days counted as full days.
3.2 Non-binding offer The Organizer’s offer is non-binding and may be withdrawn by the Organizer up to 5:00 p.m. on the next Working Day following acceptance.
3.3 The booking The Agreement is concluded as soon as the Traveler accepts the Organizer’s offer, subject to availability of the Trip.
3.4 Obvious errors Obvious errors in the offer do not bind the Organizer. If there is reason for doubt, the Traveler must inquire with the Organizer.
3.5 Preferences No rights can be derived from preferences expressed by the Traveler unless the Organizer has confirmed in Writing that such preference will be met. The mere mention of a preference on travel documents or the booking confirmation is insufficient.
3.6 Special requirements If the Traveler, at the time of booking, communicates medical requirements or other essential interests as a “requirement” to the Organizer, the Organizer will assess whether it can comply. If the Organizer cannot or does not wish to comply, the Agreement will not be concluded. The Organizer may adjust the price due to the stated requirements.
3.7 Booking confirmation After booking and verifying availability, the Organizer will send a booking confirmation.
3.8 Revocation by the Traveler A booking is final. The Traveler has no right to withdraw from the Agreement.
3.9 Minors The Traveler who books the trip must be of legal age.
3.10 Booking for other Travelers & communication The Traveler who books for other Travelers is jointly and severally liable for all resulting obligations. Each of the other Travelers is liable for their own share. The confirmation, invoice, travel documents, and all other communication are sent only to the Traveler who made the booking. The Traveler booking for others must provide relevant personal information of those Travelers and must provide them with these Terms and all other relevant communication. The Traveler booking the Trip indemnifies the Organizer from damages resulting from non-compliance with the above obligations.

Article 4 – Information provided by the Organizer
4.1 Travel price Prices shown are per person unless expressly stated otherwise.
4.2 Information at booking At or immediately after booking, the Organizer provides a deposit invoice that serves as the Agreement confirmation to the Traveler, including accepted preferences and information—based on Dutch nationality—about necessary travel documents (passports, visas, etc.) and possible health formalities.
4.3 Travel documents The Traveler must possess the necessary travel documents during the Trip, such as passport, visa, vaccination certificates, etc. Given their importance, the Traveler must verify with official authorities that the information is complete and up to date. Before booking, the Traveler must ensure sufficient time to obtain the necessary documents. If the Traveler cannot undertake (part of) the Trip due to missing documents, the costs are at the Traveler’s expense.
4.4 Travel papers Travel documents (tickets, vouchers, etc.) are sent to the Traveler no later than 7 days before departure, unless the invoice has not been fully paid. If the Traveler has not received them 5 days before departure, they must immediately notify the Organizer.
4.5 Insurance information The Organizer points out the possibility of taking out cancellation and travel insurance. The Organizer may make such insurance mandatory if the Traveler was informed of this before booking.
4.1 Travel price Prices shown are per person unless expressly stated otherwise.

If the Traveler cannot undertake (part of) the Trip due to missing documents, the costs are at the Traveler’s expense.
4.4 Travel papers Travel documents (tickets, vouchers, etc.) are sent to the Traveler no later than 7 days before departure, unless the invoice has not been fully paid. If the Traveler has not received them 5 days before departure, they must immediately notify the Organizer.
4.5 Insurance information The Organizer points out the possibility of taking out cancellation and travel insurance. The Organizer may make such insurance mandatory if the Traveler was informed of this before booking.
Article 5 – Information provided by the Traveler
5.1 Relevant information from Traveler(s) Before booking, the booking Traveler must provide all relevant information regarding the registered Travelers, especially information that may affect the health or safety of the Traveler or others. If the provided information is incorrect or incomplete, the Traveler may be excluded from participation. In that case, the Traveler owes the cancellation costs in accordance with Article 9. Any other resulting costs are also at the Traveler’s expense.
5.2 Reduced mobility, pregnancy, and illness Travelers with reduced mobility and their companions, pregnant women, and Travelers with an illness that may affect the Trip must report this to the Organizer at the time of entering into the Agreement—or as soon as possible thereafter—due to possible consequences for the Trip, especially for air travel. These Travelers must verify with the carrier whether a medical certificate is required for travel.
5.1 Relevant information from Traveler(s) Before booking, the booking Traveler must provide all relevant information regarding the registered Travelers, especially information that may affect the health or safety of the Traveler or others. If the provided information is incorrect or incomplete, the Traveler may be excluded from participation. In that case, the Traveler owes the cancellation costs in accordance with Article 9. Any other resulting costs are also at the Traveler’s expense.
5.2 Reduced mobility, pregnancy, and illness Travelers with reduced mobility and their companions, pregnant women, and Travelers with an illness that may affect the Trip must report this to the Organizer at the time of entering into the Agreement—or as soon as possible thereafter—due to possible consequences for the Trip, especially for air travel. These Travelers must verify with the carrier whether a medical certificate is required for travel.
Article 6 – Payment
6.1 Deposit The deposit amounts to 30% of the total travel sum. The deposit must be received within 14 days after booking.
6.2 Balance payment The remaining balance must be paid no later than 6 weeks before the start of the Trip. For bookings made within 6 weeks prior to departure, the full travel sum must be paid immediately after booking. In any case, full payment must be received before the start of the Trip.
6.3 Default and interest If the Traveler fails to pay within the agreed period, the Traveler is in default without further notice and statutory interest is due on the outstanding amount.
6.4 Collection costs The Traveler must pay extrajudicial collection costs if payment is not made within the final payment deadline set in a Written reminder. These costs amount to: 15% of the claimed amount up to €2500, 10% on the next €2500, 5% on the next €5000, and 1% on any excess.
6.5 Further consequences of non-payment As long as payment has not been made, the Organizer may withhold the travel documents. If payment remains outstanding after a reminder, or if payment has not been received before departure, the Organizer may exclude the Traveler from participation. The payment obligation remains in effect. Instead of exclusion, the Organizer may cancel the Agreement and charge the Traveler the applicable cancellation costs as defined in Article 9.
6.1 Deposit The deposit amounts to 30% of the total travel sum. The deposit must be received within 14 days after booking.
6.2 Balance payment The remaining balance must be paid no later than 6 weeks before the start of the Trip. For bookings made within 6 weeks prior to departure, the full travel sum must be paid immediately after booking. In any case, full payment must be received before the start of the Trip.

6.5 Further consequences of non-payment As long as payment has not been made, the Organizer may withhold the travel documents. The payment obligation remains in effect. Instead of exclusion, the Organizer may cancel the Agreement and charge the Traveler the applicable cancellation costs as defined in Article 9.
Article 7 – Substitution
7.1 Conditions and notification A Traveler may transfer the Trip to another person. The substitute must meet all conditions attached to the Trip. The Traveler must request substitution from the Organizer no later than 7 days before departure.
7.2 Joint liability and additional costs The original Traveler and the substitute are jointly and severally liable for payment of the travel sum and any additional costs arising from the substitution, including change fees.
7.1 Conditions and notification A Traveler may transfer the Trip to another person. The substitute must meet all conditions attached to the Trip. The Traveler must request substitution from the Organizer no later than 7 days before departure.
7.2 Joint liability and additional costs The original Traveler and the substitute are jointly and severally liable for payment of the travel sum and any additional costs arising from the substitution, including change fees.
Article 8 – Change at the Traveler’s request
8.1 Modification The Traveler who booked the Trip may request the Organizer to modify the Agreement. The Organizer is not obliged to comply. The Organizer will inform the Traveler of the new travel price. If the Traveler agrees with the modification costs, the new travel price and change fees become due. If the new price is lower than the original, the difference will be settled against the change fees.
8.2 Change of departure date Unless the Organizer confirms that it is a rebooking, a change of departure date constitutes cancellation of the existing Agreement and formation of a new one. The cancellation terms of Article 9 apply to the cancelled Agreement.
8.1 Modification The Traveler who booked the Trip may request the Organizer to modify the Agreement. The Organizer is not obliged to comply. The Organizer will inform the Traveler of the new travel price. If the Traveler agrees with the modification costs, the new travel price and change fees become due. If the new price is lower than the original, the difference will be settled against the change fees.
8.2 Change of departure date Unless the Organizer confirms that it is a rebooking, a change of departure date constitutes cancellation of the existing Agreement and formation of a new one. The cancellation terms of Article 9 apply to the cancelled Agreement.
Article 9 – Cancellation by the Traveler
9.1 Cancellation The Traveler may cancel the booking before the start of the Trip. Cancellation must be in Writing. The date on which the Organizer receives the cancellation counts as the date of cancellation. Cancellations received after 5:00 p.m. or on non-working days are deemed received on the next Working Day.
9.2 Cancellation fees
Cancellation up to and including 42 days before departure: the deposit must be paid
Cancellation between the 42nd and 28th day before departure: 50% of the total amount
Cancellation between the 28th and 14th day before departure: 75% of the total amount
Cancellation between the 14th and 7th day before departure: 90% of the total amount
Cancellation within 7 days before departure: the full amount must be paid.
9.3 Reduction in number of Travelers If, within one booking, the number of Travelers decreases, the same cancellation terms as in Article 9.2 apply to that Traveler.
9.4 Cancellation after rebooking If the Traveler and Organizer have rebooked the trip to a later date and the Traveler cancels the rebooked trip, the cancellation fee is at least the amount that would have applied if the trip had been canceled on the rebooking date. (Example: 14 days before the original departure, the trip is rebooked for one year later. Six months before the new trip, the Traveler cancels. The cancellation fee would be 20% under Article 9.2, but 75% if canceled on the rebooking date. In this case, 75% applies.)
9.5 Travel credits issued as goodwill If a Trip is canceled by the Traveler and a travel credit is issued as goodwill, the following applies (unless otherwise stated by the Organizer):
the credit must be used within one year of issue;
the new trip must start within two years of issue;
the credit is tied to the Traveler and is non-transferable;
the credit may only be used for the same Trip at a later date;
if the later trip is more expensive, the price difference is charged to the Traveler;
if the Traveler cancels a trip booked using the goodwill credit, the credit expires.
9.1 Cancellation The Traveler may cancel the booking before the start of the Trip. Cancellation must be in Writing. The date on which the Organizer receives the cancellation counts as the date of cancellation. Cancellations received after 5:00 p.m. or on non-working days are deemed received on the next Working Day.
9.2 Cancellation fees

9.5 Travel credits issued as goodwill If a Trip is canceled by the Traveler and a travel credit is issued as goodwill, the following applies (unless otherwise stated by the Organizer):
the credit must be used within one year of issue;
the new trip must start within two years of issue;
the credit is tied to the Traveler and is non-transferable;
the credit may only be used for the same Trip at a later date;
if the later trip is more expensive, the price difference is charged to the Traveler;
if the Traveler cancels a trip booked using the goodwill credit, the credit expires.
Article 10 – Price adjustment
10.1 Price change The Organizer may increase the travel price up to 90 days before departure due to changes in:
the cost of fuel or other energy sources, or;
taxes or fees imposed by third parties not directly involved in performing the Trip.
10.2 Termination by the Traveler If the price increase exceeds 8% of the total price, the Traveler may terminate the Agreement and will receive a refund of the amount paid.
10.3 Price reduction If the right to a price increase is agreed, the Traveler has a corresponding right to a price reduction. An administrative fee of €30 will be deducted from the refundable amount.
10.1 Price change The Organizer may increase the travel price up to 90 days before departure due to changes in:
the cost of fuel or other energy sources, or;
taxes or fees imposed by third parties not directly involved in performing the Trip.
10.2 Termination by the Traveler If the price increase exceeds 8% of the total price, the Traveler may terminate the Agreement and will receive a refund of the amount paid.
10.3 Price reduction If the right to a price increase is agreed, the Traveler has a corresponding right to a price reduction. An administrative fee of €30 will be deducted from the refundable amount.
Article 11 – Modification by the Organizer
11.1 Changes The Organizer may unilaterally make minor changes to the Trip before its start. The Traveler will be informed of these changes.
11.2 Significant changes If necessary, the Organizer may significantly modify the main features of the Trip before its start. This also includes offering an alternative Trip. The Traveler may accept the modification or terminate the Agreement without paying cancellation fees. In the event of termination, the Organizer will refund all amounts paid by the Traveler. The Organizer may give the Traveler a reasonable deadline within which the Traveler must communicate their decision. If the Agreement is not terminated within this period, the modification will be deemed accepted, and the right to termination will expire.
11.1 Changes The Organizer may unilaterally make minor changes to the Trip before its start. The Traveler will be informed of these changes.
11.2 Significant changes If necessary, the Organizer may significantly modify the main features of the Trip before its start. This also includes offering an alternative Trip. The Traveler may accept the modification or terminate the Agreement without paying cancellation fees. In the event of termination, the Organizer will refund all amounts paid by the Traveler. The Organizer may give the Traveler a reasonable deadline within which the Traveler must communicate their decision. If the Agreement is not terminated within this period, the modification will be deemed accepted, and the right to termination will expire.
Article 12 – Cancellation by the Organizer
12.1 Cancellation due to minimum participant numbers: N/A
12.2 Cancellation due to force majeure The Organizer may cancel the Agreement before the start of the Trip if the Organizer cannot perform the Agreement due to unavoidable and extraordinary circumstances.
12.3 Refund of travel sum – no compensation In the above cases, the Organizer will refund all received amounts within 14 days, and no damages are due. Costs incurred by the Traveler for services outside the Agreement—such as vaccinations, visas, purchase of materials, insurances, or flights, tickets, or accommodations not included in the Trip—are not reimbursed.
12.4 Cancellation due to the Traveler’s actions If the Traveler fails to meet participation requirements or provides incorrect or incomplete information, the Organizer may cancel the Agreement. The Traveler then owes cancellation fees as defined in Article 9.
12.1 Cancellation due to minimum participant numbers: N/A

12.4 Cancellation due to the Traveler’s actions If the Traveler fails to meet participation requirements or provides incorrect or incomplete information, the Organizer may cancel the Agreement. The Traveler then owes cancellation fees as defined in Article 9.
Article 13 – Responsibility & Deficiencies
13.1 Proper performance of the Trip The Organizer is responsible for the performance of the agreed Travel Services, whether carried out by the Organizer or another Travel Service Provider. The Organizer must execute the Agreement in accordance with the expectations that the Traveler could reasonably have based on the publications, the Agreement, and the circumstances at the travel destinations.
13.2 Changes in itinerary and travel times The Organizer will inform the Traveler of any changes in the itinerary. If the Organizer does not know the Traveler’s location, information will only be sent to the e-mail address or mobile number known to the Organizer.
13.3 Traveler’s duty to report complaints The Traveler must immediately inform both the Travel Service Provider and the Organizer of any deficiencies or problems in the execution of the Travel Services in accordance with Article 17.
13.4 Solution by the Organizer The Organizer will ensure that deficiencies are remedied. A deficiency need not be remedied if it is impossible or entails disproportionately high costs.
13.5 Compensation If the deficiency cannot be remedied, the Organizer (or Travel Service Provider) will consult with the Traveler and may, where appropriate, arrange compensation or an alternative. The Traveler is not entitled to compensation or an alternative if the deficiency is attributable to the Traveler.
13.1 Proper performance of the Trip The Organizer is responsible for the performance of the agreed Travel Services, whether carried out by the Organizer or another Travel Service Provider. The Organizer must execute the Agreement in accordance with the expectations that the Traveler could reasonably have based on the publications, the Agreement, and the circumstances at the travel destinations.
13.2 Changes in itinerary and travel times The Organizer will inform the Traveler of any changes in the itinerary. If the Organizer does not know the Traveler’s location, information will only be sent to the e-mail address or mobile number known to the Organizer.
13.3 Traveler’s duty to report complaints The Traveler must immediately inform both the Travel Service Provider and the Organizer of any deficiencies or problems in the execution of the Travel Services in accordance with Article 17.
13.4 Solution by the Organizer The Organizer will ensure that deficiencies are remedied. A deficiency need not be remedied if it is impossible or entails disproportionately high costs.
13.5 Compensation If the deficiency cannot be remedied, the Organizer (or Travel Service Provider) will consult with the Traveler and may, where appropriate, arrange compensation or an alternative. The Traveler is not entitled to compensation or an alternative if the deficiency is attributable to the Traveler.
Article 14 – Assistance and Support
14.1 Mandatory assistance The Organizer shall provide assistance and support to the Traveler if the Traveler is in difficulty, in particular by providing information on medical services, local authorities, and consular assistance, and by helping the Traveler with remote communications and finding alternative travel arrangements.
14.2 Costs The Organizer will charge a reasonable fee for such assistance if the difficulties were caused by the Traveler’s intentional or negligent conduct.
14.1 Mandatory assistance The Organizer shall provide assistance and support to the Traveler if the Traveler is in difficulty, in particular by providing information on medical services, local authorities, and consular assistance, and by helping the Traveler with remote communications and finding alternative travel arrangements.
14.2 Costs The Organizer will charge a reasonable fee for such assistance if the difficulties were caused by the Traveler’s intentional or negligent conduct.
Article 15 – Attribution, Force Majeure, and Liability Exclusions
15.1 Attribution & force majeure The Traveler is not entitled to compensation for damage suffered as a result of a deficiency attributable to: a. the Traveler; b. third parties not directly involved in the execution of the Agreement, where the deficiency could not have been foreseen or prevented; or c. unavoidable and extraordinary circumstances.
15.2 Limitation of liability The Organizer’s total liability for damages is limited to three times the total travel sum, unless the damage results from the Traveler’s death or personal injury, or the damage was caused intentionally or by gross negligence of the Organizer.
15.3 Liability under conventions or EU regulations If the Organizer is liable for any damage, including death or personal injury of the Traveler, such liability shall be limited or excluded in accordance with the applicable international conventions and/or EU regulations concerning the individual Travel Services.
15.4 Insured damages The Organizer is not liable for damages covered by insurance, such as health, travel, event, or cancellation insurance.
15.5 Prescription Any claim by the Traveler for damages or other demands expires two years after completion of the Trip. If the Trip did not take place, the limitation period starts two years after the planned start date.
15.6 Expiration of rights Without prejudice to the limitation period and the duty to complain in time, any claim by the Traveler for damages expires three years after the start date of the Trip.
15.7 No double compensation The Traveler is not entitled to double compensation. If the Traveler is entitled to compensation under international conventions or EU regulations, they cannot also receive compensation under this Agreement.
15.1 Attribution & force majeure The Traveler is not entitled to compensation for damage suffered as a result of a deficiency attributable to: a. the Traveler; b. third parties not directly involved in the execution of the Agreement, where the deficiency could not have been foreseen or prevented; or c. unavoidable and extraordinary circumstances.
15.2 Limitation of liability The Organizer’s total liability for damages is limited to three times the total travel sum, unless the damage results from the Traveler’s death or personal injury, or the damage was caused intentionally or by gross negligence of the Organizer.

Article 16 – Obligations of the Traveler
16.1 Conduct and compliance with instructions The Traveler must behave as a reasonably responsible traveler and is obliged to follow all instructions from the Organizer and the Travel Service Providers.
16.2 Consequences of non-compliance – exclusion from participation If the Traveler fails to follow instructions or causes disturbance, the Organizer or Travel Service Provider may partially or fully exclude the Traveler from further participation in the Trip. In such a case, the Traveler is not entitled to any refund. Any additional costs arising from this are at the Traveler’s expense.
16.3 Warning Before being excluded from participation, the Traveler will first receive an oral or written warning. A warning is not required if circumstances make it unreasonable to give one.
16.4 Liability of the Traveler and indemnification The Traveler is liable for any damage caused by their behavior, by failure to meet the obligations in this article, or for any damage otherwise attributable to them. The Traveler indemnifies the Organizer against any claims from Travel Service Providers, other Travelers, or third parties involved in the Trip for damage caused by or attributable to the Traveler.
16.5 Verification of return travel time The Traveler must verify the exact departure time no later than 24 hours before the planned start of the return journey.
16.6 Formal health requirements The Traveler must comply with all health requirements applicable at the destination (and any transit countries). Governments may change these requirements without notice. The consequences of such changes fall within the Traveler’s own risk.
16.7 Measures by Travel Service Providers Travel Service Providers may take all reasonable measures and require cooperation from Travelers, including those intended to prevent and manage emergencies, limit health risks, prevent damage, or comply with government regulations. If these measures or instructions are not followed, the Traveler may be denied the service or access.
16.8 Use of materials The Traveler must handle all provided materials with care. Upon receipt, the Traveler must inspect these items and immediately report any defects. The Traveler is liable for any damage, loss, or theft of materials made available to them.

Article 17 – Complaints
17.1 Information The Organizer provides the Traveler with emergency contact details prior to the start of the Trip.
17.2 Reporting on-site If the Traveler believes that the Trip is not being carried out properly, they must immediately report the issue or defect to the relevant Travel Service Provider so that it can be resolved. If a tour leader representing the Organizer is present, the complaint must also be reported to them immediately. 17.3 Communication costs The Traveler must minimize communication costs by using internet calls, WhatsApp, or e-mail where possible.
17.4 Unresolved complaint after return All complaints that, in the Traveler’s opinion, were not fully resolved or compensated during the Trip must be submitted to the Organizer in Writing, with reasons, within two months after the end of the Trip.
17.5 Consequences of failure to report or late reporting Failure to report a deficiency or complaint in accordance with Article 17.2 may affect the amount of any compensation, unless the Organizer’s interests were not harmed by the delay. Complaints submitted after return that are not received within the specified time frame will not be processed unless it would be unreasonable to enforce this deadline in the given circumstances.
17.1 Information The Organizer provides the Traveler with emergency contact details prior to the start of the Trip.

Article 18 – Miscellaneous Provisions
18.1 Rights of third parties Employees, agents, and other third parties involved in the execution of the Agreement may invoke the provisions of the Agreement and these Terms and Conditions (including exclusions of liability) against the Traveler.
18.2 Substitute provisions If mandatory law prevents the validity of any provision in these Terms and Conditions, or if a provision is annulled, that provision will be deemed replaced by a valid one that most closely reflects the original intent and meaning.
18.3 Applicable law The offer, the Agreement, and its execution are governed exclusively by Dutch law, unless this conflicts with mandatory law. If the consumer resides outside the Netherlands at the time of booking, the following applies: Despite the choice of law, the consumer retains the protection granted by the mandatory laws of their country of residence, if (cumulatively): the Organizer directs its commercial activities for the agreed Trip toward that country; and the agreed travel services are performed wholly or partly in that country.
18.4 Competent court The court in the district where the Organizer is established has exclusive jurisdiction over all disputes concerning the Agreement and related matters, unless this conflicts with mandatory law. The Organizer is also entitled to summon the Traveler before the court of the Traveler’s residence.
